TERMS AND CONDITIONS

Each student is required to fill accept this form prior to attending a wine course at Florida Wine Academy LLC.

In consideration of the acceptance of my application for entry in the Florida Wine Academy wine courses, I hereby waive and release any and all claims for personal injury, property damage or death which may in any way result from my participation in this wine class/course. By signing this release, I intend to discharge in advance Florida Wine Academy, its employees, educators and any other person connected with the class from any and all liability arising in any way with the class.

ASSUMPTION OF RISK
I am aware that participating in a wine class involves hazardous activities. I am voluntarily participating in these activities with knowledge of the dangers involved and hereby agree to accept and assume any and all risks of injury and death.

INDEMNITY AGREEMENT
I further hereby agree to indemnify and hold the Florida Wine Academy harmless from any and all claims, suits, liability, injuries, losses and damages, to the person or property of any individual or entity which arises out of my participation in the class.

I understand and agree that this waiver, release, assumption of risk and indemnity agreement binds my heirs, dependents and assigns. The naming of any parties in this release is not intended to imply that they are joint ventures or have any right of control of the class’s participants.

CONTROL AGREEMENT: I hereby agree that I will hold only myself responsible for consuming alcohol and the amount of alcohol I consume in class, and that I will practice good judgment if I choose to consume alcohol. I authorize the instructor to cease my access and consumption to alcohol, stop my consumption of alcohol, and call me a cab at my own expense if he/she feels, in his/her sole discretion that I have had too much to drink.

In accepting these conditions, I ACKNOWLEDGE AND REPRESENT THAT I HAVE READ the above Waiver and Liability Agreement, I UNDERSTAND IT AND AGREE WITH IT VOLUNTARILY as my own free act and deed; no oral presentations, statements, or inducements, apart from the foregoing agreement, have been made; I am at least twenty one (21) years of age and fully competent; and I execute this Release for full, adequate and complete consideration fully intending to be bound by same.

Payment Terms: We accept payments in personal check, credit card (VISA, Mastercard), Paypal or cash. All payments must be done, before the course starts.

Refund Policy: If you need to cancel or change the date of the course for any reason you must do so 14 working days before the course starts, and we will charge a $25 administrative fee. Making changes to your reservation within 13 business days of the start date will result in an administrative change fee of 25% of the cost of the course. No refunds are given for changes made within 3 business days of the start of the course.

Other terms and conditions: Student must be 21 years of age or older to enroll in any course offered by Florida Wine Academy. Please note that your booking is not secured until payment is received; all courses must be fully paid in advance. We reserve the right to cancel or reschedule any course or event. Location is also subject to change. Materials will be posted to the student’s address on confirmation of payment of fees. Advanced preparation with study materials is highly recommended. Prices include workbook, registration and exam fees, venue, tasting samples, and instructors.

Reasonable Adjustments: Florida Wine Academy welcomes candidates that might need special requirements to reduce the effect of a disability or difficulty that places the candidate at a substantial disadvantage in the teaching situation. Our building is equipped with elevators and the classroom has no steps, allowing candidates in wheelchair or persons with limited mobility to access the room easily. If the candidate needs the presence of a facilitator in the room, this can be arranged if required by the time of registration and if the candidate proves the need for any accommodations to be made. Other reasonable adjustments can be made, depending on the case and in accordance to our Policy for Candidates Requiring Reasonable Adjustments.
